Travel Picture of the Week Terms & Conditions

1. These Terms & Conditions apply to a contributor (‘you’) submitting your image or images (‘your content’) to West Australian Newspapers Limited (ABN 98 008 667 632) (WAN, we, us, our) to Travel Picture of the Week.

2. Your content should be submitted at our travelphoto@wanews.com.au inbox and must include your name.

3. You grant WAN a non-exclusive, royalty-free, perpetual licence to publish, transmit or otherwise use your content in our eTravel Digital Edition, Saturday Travel, Sunday Travel, West Travel’s social media channels and at thewest.com.au (together, ‘our Publications’).

4. If your content is used in any of our Publications, attribution will be given by publishing your name as the photographer.

5. You retain copyright and any other rights you hold in your content and you can continue to share and use it as you wish.

6. You warrant that your content is your original work and that you have not copied any part of another person’s work or used any artificial intelligence application, system or tool to create your or overly enhance your content. (The extent of any enhancement is judged by the West Travel team and their assessment is absolute and final.).

7. You warrant that you have all of the necessary rights, including copyright, in your content and that neither it, nor our using it in any of our Publications, will infringe any law.

8. You warrant that, where appropriate: (i) you have the permission of anyone appearing in your content; (ii) you are not infringing anyone’s rights by submitting your content to WAN; and, (iii) you have the consent of the parent or guardian of any person under the age of 18 who is featured in your content.

9. You consent to WAN engaging in any action or omission which may infringe your moral rights in relation to your content.

10. You indemnify WAN against any and all legal fees, damages and other expenses that may be incurred as a result of a breach of the above warranties.

11. You should keep a copy of your content as WAN may not archive, store or back-up your content nor continue to make your content accessible online.
