Halls Creek chief executive wants specialist First Nations court to tackle youth crime

An East Kimberley town wants to see tribal justice introduced as the community desperately tries to come up with solutions to tackle the rising rates of youth crime. Shire of Halls Creek chief executive Phillip Cassell will make the call for the establishment of a specialist court for the town — where Aboriginal elders would sit on the bench with a magistrate — at a community safety solutions forum to be held in December. The police and mental health commissioners as well as the director generals of the departments of Justice, Health, Education, Communities and Local Government have been invited to the forum to help tackle a wave of vehicle thefts, robberies, break-ins and vandalism plaguing the town. Mr Cassell said he had the backing of local elders and police for what they describe as “tribal justice”. “The police are very interested in it, the elders here are very interested in it. They are all fully supportive of moving in this direction,” he said. He said they want to establish something similar to Murri Court in Queensland. At Murri Court, elders and a community justice group work with offenders on addressing the causes of their offending and keep the magistrate informed of their rehabilitation progress prior to sentencing. Mr Cassell said he believed a similar court in Halls Creek could have a big impact on rates of re-offending. “I don’t think it would be as successful in the cities, I think it is more relevant out here in regional and remote areas where there is a stronger attachment to culture and a traditional way of life,” he said. The Law Society of WA backs the idea. Greg McIntyre SC, who chairs the Law Society’s Indigenous Legal Issues Committee, said the current system was not working. “Detaining kids at Banksia Hill and the Casuarina prison special wing is clearly not working and the Supreme Court said recently it is not operating in a way that is lawful,” he said. “So finding ways of creating responses to misbehaviour by children which is local to the area … is more likely to work. “It makes what is happening in the court more relevant to the local community rather than being something entirely divorced from the community and delivered by someone who has only a limited understanding of the culture of the indigenous people that he or she is dealing with.” Youth crime is having a significant impact on services and facilities in Halls Creek. In October the Shire approved Kimberley Hotel’s application to have an electric fence built around the pub to stop burglaries. That same month four staff at Halls Creek People’s Church Frail Aged Hostel left town following a rock attack by youths on the facility during which one staff member was injured. The town’s Community Connect bus, which takes home vulnerable children and people affected by drugs or alcohol, was taken off the road after rocks “the size of dinner plates” were thrown at it while it was moving. Western Australia used to have specialist courts for Aboriginal offenders in Kalgoorlie as well as metropolitan courts for Indigenous domestic violence perpetrators but they were discontinued in 2015 because of a lack of evidence that they made any difference to the rates of re-offending. Now there is only one specialist court in WA, Barndimalgu Aboriginal Family Violence Court in Geraldton. Besides Queensland, First Nations specialist courts exist in Victoria (Koori Courts) and South Australia (Nunga Courts). There is also a push to establish them in NSW (Walama Courts). Mr McIntyre said a specialist court could be established either through a statutory change or informally by a local magistrate. “It may need some degree of endorsement by the Department of Justice but it is open to the magistrate how to manage their court, obviously they would still have to comply with the law.” A spokesman from the Department of Justice said a specialist First Nations court was not under consideration however they looked forward to discussing a range of ideas at the upcoming forum. “As part of the Kimberley Juvenile Justice Strategy, the Department of Justice supports community-led initiatives that aim to reduce young people’s interactions with the justice system,” he said. “This includes contributing funding towards the delivery of Olabud Doogethu Aboriginal Corporation programs in Halls Creek, through the Shire of Halls Creek as the backbone organisation.”
