A sell-out in sly grog street: Kununurra cops say they need new law to halt thriving bootleg booze trade

It’s 7.13am on one of Kununurra’s sly grog streets and the third person that morning leaves a ramshackle house carrying alcohol. The man holds a carry box for half a dozen bottles of Gossips wine to his chest and climbs into the waiting taxi. A box of half a dozen Gossips chardonnay would cost $66 at the Thirsty Camel bottle shop 2.5 km away but on the street the going price is $180. He is quickly followed down the driveway by two more men. One man in a cap clutches two bottles of Gossips chardonnay in the crook of his arm which cost $30 each on the black market as opposed to $10.99 at the bottle shop. His companion has a cooler bag slung over his shoulder and they walk off together down a dirt track in the long grass. Forty minutes later a silver four-wheel-drive pulls up. A woman walks in and comes out soon afterwards carrying a VB box on her hip. A slab of VB costs about $77 in the bottle shop but $150 from bootleggers. The street has most of its visitors when the bottle shops in Kununurra are shut, before 12pm and after 8pm. Kununurra police officer-in-charge Sen. Sgt Neil Vanderplank said sly groggers in town were “vultures that prey on the vulnerable”. “They don’t care who they are hurting as long as they get their money,” he said. But there is hope the beefed-up banned drinkers register, which is set to be passed into law later this month, will give police another weapon to crack down on the pernicious trade. The Liquor Control Amendment (Banned Drinkers Register) Bill will make it far easier to blacklist problem drinkers by allowing police and the courts to place people on the booze ban who have committed alcohol-related offences. The Bill also makes it an offence to supply someone on the BDR with alcohol, meaning police would only have to prove the sly groggers gave a problem drinker alcohol not that they sold it and made a profit. The offence of supplying someone on the banned drinkers register carries a fine of $10,000. The alcohol-related offence also means the sly grogger can be placed on the register. Sen. Sgt Neil Vanderplank said he believed the BDR would “definitely add another string to the bow” in tackling sly grogging. “It will provide us with one more avenue to restrict the ease with which the people are supplying alcohol to the vulnerable,” he said. “At the moment we need specific information about it occurring, and at what house, but as quick as the information comes to us the liquor is already sold out. “It needs to be beyond reasonable doubt that they sold sly grog. We need to prove they made a profit and the transaction has occurred. The people doing the purchasing need to give statements.” Currently the best way for police to tackle the problem in the Kimberley is on the road with the liquor carriage limit laws which prevent anyone from carrying more than one carton of beer and/or three bottles of wine and/or one litre of spirits. Binarri Binyja Yarrawoo chair Des Hill said people had given up trying to stop the sly groggers and he was sceptical that the BDR would make a difference. “The police have been told about people locally, unless you go buy it from someone and then go to the police the cops won’t do anything so people don’t even bother dobbing other people in,” he said. “People have given up hope because they have to live in this town, if people find out they are reporting black market alcohol there will be strife.” Mr Hill said of the BDR, “I don’t think that thing works.” Up until now, the trialled BDR in the Kimberley has been a failure with under 90 people on the blacklist out of a population of 38,000. But it is expected the amendments will see hundreds of people on the list. “I can go in there and buy VB but how do you prove that I’m not buying it for someone who is on the register?,” he asks. Mining and Pastoral Region MLC Neil Thomson said he supported the beefing up of the BDR because it was a “more targeted approach” to problem drinking in the Kimberley rather than the confusing patchwork of restrictions in each town. “But I would like to see wraparound services for those people, particularly to address the massive domestic violence numbers in the Kimberley,” he said. Recent crime statistics show family assaults are 17 times higher in the Kimberley than in metro areas. But Mr Thomson fears the BDR might not help crack down on sly grogging but, in fact, allow it to thrive among desperate drinkers who have been cut off at the bottle shop. “With forms of prohibition we know they always result in illegal activity, sly grogging and inflated prices. This could foster a very negative black market activity,” he said. Back at the street taxis and private cars full of people keep turning up until 11am, but now they are walking out empty-handed. They crisscross the street going from house to house. A man at one house shakes his head and makes a shooing motion. The Kimberley Echo was told by sources the houses had sold out of alcohol for the morning. The high demand was believed to have been fuelled by a two-day police operation at Kununurra’s two bottle shops ahead of the footy weekend. Police were checking everyone’s licence at the bottle shop for criminal history and deciding who could purchase alcohol. The owner of Liquor Barons bottle shop and Gulliver’s Tavern, Darren Spackma, said he welcomed the police operation because the people they were targeting were not the customers he wanted at his business. Sen. Sgt Vanderplank supported the bottle shop owners. “The grog could have come from anywhere. There is no bottle shop that is the issue in town, it’s these vultures preying on these vulnerable people,” he said. Time will tell if the BDR will be effective in cutting off the sly-groggers for good — or make it worse.
