Josh Warneke inquest: Broome ambulance officer says injuries, scene not consistent with hit-and-run

The volunteer ambulance officer who first examined Josh Warneke has told an inquest into his death that she saw no evidence of tyre marks on his body despite initial police suspicions that he was the victim of a hit-and-run. Mr Warneke’s body was found on the outskirts of Broome on February 26, 2010, after he spent the night out with friends and decided to walk home to Roebuck Estate. Mr Warneke, 21, was last seen walking near Old Broome and Bagot roads around 2:45am. A taxi driver found him with a severe head injury shortly after. Giving evidence on the second day of the inquest in Broome on Tuesday, volunteer ambulance officer Linley Anne Cillia testified that she arrived at the scene with a fellow volunteer paramedic at approximately 3:18am that morning. Ms Cillia was first alerted to the incident by pager who informed her their was a code 90 — meaning presumed dead — on Old Broome Road. At the time of the page they were taking a separate patient deemed “unconscious” from the local Bungalow Bar to Broome Hospital. Ms Cillia said once she had transferred their patient, and they were making their way to where Mr Warneke was found, they received a call from police who said they suspected the incident to be a hit-and-run. She told the court that she had attended hundreds of hit-and-runs and the scene did not seem like one to her. Mr Warneke’s body sprawled out onto the road surrounded by a “pool of congealed blood”, Ms Cillia said. She told the court that she observed swelling of Mr Warneke’s left eye, as well as surrounding bruising. On his right arm she deemed the discolouration as likely “bruising” not tyre marks. On the opening day of the inquest on Monday, the court was told that a number of experts would give differing opinions as to how Mr Warneke sustained those injuries. Some of those experts were of the opinion Mr Warneke was struck by a car while he was lying on the road. But other experts were of the opinion he was not struck by a vehicle at all, but was hit in the head one or several times by an object causing blunt force trauma. Two years after Mr Warneke’s death, Indigenous man Gene Gibson was charged with his murder, but the charge was later reduced to manslaughter due to procedural errors, including failure to provide an interpreter and improper cautioning. A Corruption and Crime Commission report criticized the investigation as deeply flawed. Gibson was sentenced to 7 and a half years in 2014 but was released in 2017 after the Court of Appeal deemed his conviction unsafe. Following his release, cold case detectives reopened the investigation and offered a reward, initially $250,000 and later increased to $1 million. The inquest continues.
