Erick Omondi Kiaye: Aged care worker faces shocking allegations of indecently dealing with dementia patient

A Perth aged care worker allegedly found with his trousers down and on top of a vulnerable dementia patient told his colleague he “just wanted some affection” when he was sprung. Erick Omondi Kiaye was allegedly caught by a nurse inside a 66-year-old resident’s bedroom at Brightwater Madeley after 4am on February 16. The allegations against the 51-year-old were aired in Joondalup Magistrates Court where he appeared via video link from Hakea Prison to apply for bail. Police prosecutor Kylie Velios said when the nurse unlocked the door and entered the victim’s dark room, the victim allegedly had her pants down and legs splayed and that a startled Mr Kiaye, who allegedly had his trousers down, said: “It’s not what you think.” “(He was) saying his mother had passed away and just wanted some affection,” Sgt Velios said. The nurse had been alerted to the locked room in the dementia secure wing when movement sensors went off. Sgt Velios opposed bail, arguing that the prosecution had a “strong case”. But Mr Kiaye’s lawyer Louis Morris Kristopher said his client was at the foot of the bed and there was “no suggestion in the prosecution” that there was inappropriate touching. However, Sgt Velios alleged Mr Kiaye was found on top of the woman who was lying on her back in her bed and he jumped off when the nurse arrived. Magistrate Raelene Johnston granted him bail given a trial could be up to two years away and after hearing his lawyer describe him as being of “prior good character”. He had been a carer for more than 16 years, and had been named a Brightwater Madeley employee of the month in 2024 “for care of patients in that facility”. Mr Kristopher also said his client, who had been on night duty at the time of the alleged incident, had the support of his wife, and his family were at the back of the court. Ms Johnston said Mr Kiaye was facing a “very serious allegation” and was not to go near any nursing homes and was to report to Ellenbrook police station each week from his home in Brabham. “If convicted of this offence, a term of imprisonment is absolutely on the cards,” she said. Outside court, Mr Kristopher said the charge of indecently dealing with an incapable person would be defended. “There is quite a lot to be disclosed in terms of the prosecution case,” he said. “And in our view it is a weak prosecution case.”
