Glen Bartlett told he can continue his defamation claim against Melbourne Football Club but only in Victoria

The potentially scandalous defamation claim launched by former Melbourne president Glen Bartlett against the leaders of the club can go ahead in the Federal Court — but only in Victoria. For nearly two years, Mr Bartlett has been suing his successor Kate Roffey and several other Demons’ board members over a trio of publications that he says defamed him by denigrating his time in the top job at the historic AFL club. The action was first filed in WA’s Supreme Court but after applications by the Demons’ hierarchy, a judge ordered it be moved to Melbourne. Mr Bartlett promptly dropped that action and started another in the Federal Court, which was opposed by Ms Roffey’s lawyers as an abuse of process. The argument to throw the action out was made in March. On Thursday, Justice Craig Colvin made his ruling, saying it was an abuse of process — but it should not put the claim to an end. Instead, if Mr Bartlett wants to plough on he will have to do so before a Federal Court judge in Victoria. And first, will have to pay the costs of his abandoned action in the Supreme Court. “It is the attempt to circumvent the considered decision of the Supreme Court to which Mr Bartlett submitted, and only once the outcome was known to be adverse to Mr Bartlett, that is at the heart of the abuse,” Justice Colvin ruled. “The decision … was to the effect that Victoria was the proper place.” In earlier hearings, Ms Roffey’s lawyers agreed that any potential trial was likely to become a “media circus”. They said that the trial would be mostly made up of witnesses from Victoria, possibly including AFL boss Gillon McLachlan and chairman Richard Goyder, talking about Victorian publications made about a Victorian club. Mr Bartlett’s lawyers fought that move, arguing that holding the trial in Melbourne would severely impact the mental health of Mr Bartlett and his partner. Mr Bartlett is considering whether to continue the action. If he does, he will reportedly consider widening it to include action against premiership captain Max Gawn, premiership coach Simon Goodwin and premiership chief executive Gary Pert. If actioned, the claims would be based on an interview with Mr Pert on SEN in October 2023. “I’ve got to say, I’ve been in the game now for 40 years. Our culture at the club, men’s and women’s programs, is the best I’ve seen in 40 years,” he said at the time. “That’s because of the people, the leadership, the clarity and strength and resilience of that culture.” Since then, Melbourne’s on-field form has resulted in them missing the 2024 finals and the club’s leadership come under increasing scrutiny. Questions remain around midfielder Clayton Oliver, while star Christian Petracca is reportedly disillusioned and premiership player Alex Neil-Bullen wants a trade back to South Australia for family reasons.
