Department seeks legal advice on council disqualification exemption for Harold Tracey

The Department of Local Government has confirmed it is looking into whether much-loved Broome councillor Harold Tracey can be exempted from council disqualification on compassionate grounds following the death of his wife. On September 7 the Shire of Broome announced Cr Tracey would be disqualified from the council after failing to request leave on three consecutive council meetings in June, July and August while grieving the loss of his wife. Under the Local Government Act 1995 any councillor who fails to attend three consecutive council meetings without leave is to be disqualified from continuing to hold office. The rule helps to ensure council members who receive fees and allowances attend meetings and make decisions, according to the department. Mr Tracey had stood by his wife Maureen’s side throughout an extended battle with illness until she died in July. When asked whether an exemption could be made for the revered former shire president considering the circumstances, a Department of Local Government, Sport and Cultural Industries spokesperson said the department was looking into its options. “This is a very unfortunate and disappointing situation,” they said. “DLGSC is obtaining legal advice on possible options to appeal this Local Government Act provision on compassionate grounds. “The department will examine whether a more compassionate and sensible outcome can be achieved assuming Mr Tracey wants to remain in the role.” It comes before the Shire of Broome elections set for October 21.
