A 46-year-old Broome man has been fined for sexually assaulting a woman at Broome Golf Club on August 6. Appearing in Broome Magistrates Court on October 10, Wayne Robert Stewart was fined $1200 for one count of unlawful and indecent assault against a 56-year-old woman at the Broome Golf Club. The court was told the crane operator had consumed eight beers before arriving at the Broome Golf Club. While drinking at the club and standing in the outside smokers’ area of the restaurant, Stewart groped the woman’s breast, squeezing for a couple of seconds before letting go. The event was seen by several witnesses and caught on the venue’s CCTV. The complainant, who was not known to Stewart before the assault, then returned to the restaurant area and started crying before Stewart came over and apologised to her. The defence said Stewart’s behaviour was out of character and asked for his conviction to be spent due to the impact a recorded conviction would have on his life and the fact the offending was on the lower end of the spectrum of indecent assault. Magistrate Anthony Sullivan said a spent conviction and a fine was appropriate in Stewart’s case. “It is a significant invasion of the victim’s personal space but, as I say, the apology offered immediately after would have gone some way to assuaging the complainant’s understandable indignation at your conduct,” he said. Stewart was fined $1200 and received a spent conviction.
